RockBox Party Hire – Terms & Conditions

These Terms & Conditions apply to all equipment hired from RockBox Party Hire. By making a booking, accepting delivery, collecting equipment, or allowing equipment to be delivered or installed, the hirer agrees to these Terms & Conditions.

1. Booking & Acceptance

A booking is confirmed only when RockBox Party Hire has provided written confirmation of the booking.

The hirer agrees that these Terms & Conditions form part of the hire agreement.

Any variation to these Terms & Conditions must be agreed to by RockBox Party Hire in writing.

2. Delivery, Collection & Access

When RockBox Party Hire delivers or collects equipment, the hirer is responsible for ensuring that there is suitable parking and reasonable access to and from the venue.

This is particularly important for deliveries and collections in Wellington CBD and other locations where parking or access may be restricted.

RockBox Party Hire may be required to move a significant amount of equipment, potentially weighing more than 100 kg. The hirer must therefore advise RockBox Party Hire in advance of any access difficulties, including:

  • Restricted or difficult parking
  • Stairs
  • Long distances between parking and the venue
  • Narrow entrances or doorways
  • Lifts or access restrictions
  • Difficult loading or unloading areas
  • Restricted delivery times
  • Any other circumstances that may make delivery or collection difficult

Additional delivery or collection charges may apply where special arrangements are required.

If suitable access is not available, RockBox Party Hire reserves the right to delay delivery, charge additional costs, or decline delivery where it is reasonably unsafe or impractical to do so.

3. Equipment Demonstration

When equipment is delivered or collected directly from RockBox Party Hire, the hirer may be shown how to operate the equipment.

The equipment will be checked before being hired out and will be supplied in working order and suitable for its intended use.

The hirer is responsible for following the operating instructions provided by RockBox Party Hire and must not misuse, modify, dismantle or attempt to repair the equipment.

4. Hire Period

The standard hire period is overnight.

Unless otherwise agreed, equipment will normally be:

Delivery / Collection: Mid to late afternoon on the day of the hire.

Return / Collection: Before 12:00 noon the following day.

Alternative hire periods may be available by prior arrangement with RockBox Party Hire.

Late Returns

Equipment must be returned or made available for collection at the agreed time.

RockBox Party Hire reserves the right to charge for late returns.

Late-return charges may be calculated on a pro-rata basis using the applicable hire rate. If the late return prevents the equipment from being supplied to another customer, RockBox Party Hire may charge for the full additional hire period or any reasonable resulting costs.

5. Condition of Equipment

All equipment is inspected before and after each hire.

The hirer must return all equipment in substantially the same condition in which it was supplied, allowing for normal wear and tear.

Equipment must be returned clean and free from food, drink, rubbish, dirt, smoke residue, candle wax and other substances.

A reasonable cleaning charge may apply where equipment requires additional cleaning due to the hirer’s use.

6. Damage, Loss & Theft

All equipment remains the property of RockBox Party Hire or its equipment owners at all times.

The hirer is responsible for the equipment from the time it is delivered, installed, collected by the hirer, or otherwise placed into the hirer’s care until it is returned to and accepted by RockBox Party Hire.

The hirer may be responsible for reasonable costs arising from:

  • Loss of equipment
  • Theft
  • Accidental damage
  • Deliberate damage
  • Damage caused by misuse
  • Damage caused by negligence
  • Damage caused by unauthorised modification
  • Damage caused by liquid, food, smoke, candle wax or other substances
  • Damage caused by operating equipment outside the instructions provided

Where equipment is damaged, RockBox Party Hire may charge the reasonable cost of repair.

Where equipment is lost, stolen or damaged beyond economical repair, the hirer may be responsible for the reasonable replacement cost of the equipment.

RockBox Party Hire will provide the hirer with reasonable details of any damage or loss claim.

7. Equipment Inspection After Hire

RockBox Party Hire will inspect returned equipment as soon as reasonably practicable after the hire period.

Where damage or loss is identified, RockBox Party Hire will notify the hirer within a reasonable period.

The hirer may be asked to provide relevant information regarding the circumstances in which the damage or loss occurred.

Nothing in these Terms & Conditions limits any rights the hirer may have under applicable New Zealand law.

8. Examples of Misuse

The following are examples of activities that may damage equipment and must not be carried out.

Karaoke & Jukebox Equipment

Do not unplug a karaoke or jukebox computer from the mains power while it is operating.

The system should always be shut down correctly before the power is disconnected.

Do not:

  • Swing microphones by their cables
  • Pull, stretch or excessively bend microphone cables
  • Place drinks on or near electronic equipment
  • Spill alcohol or other liquids on equipment
  • Place candles near equipment
  • Attempt to open, repair or modify equipment
  • Move equipment without permission where moving it could cause damage

Karaoke Song Books

Karaoke song books must be treated with care.

Do not:

  • Tear pages out
  • Write extensively in the books
  • Use pages as notepaper
  • Burn or damage pages with cigarettes
  • Spill drinks or other liquids on the books

Damage or replacement costs may apply where song books are damaged or lost.

9. Sound System Use

RockBox Party Hire equipment is designed to provide high-quality sound when operated correctly.

Excessive volume, excessive bass or amplifier clipping can cause permanent damage to speakers and amplifiers.

To reduce the risk of equipment damage:

  • Keep the volume at a reasonable level
  • Do not continually operate the system at maximum volume
  • Avoid excessive bass settings
  • Do not deliberately cause the amplifier to clip or distort
  • Do not allow guests to repeatedly increase the volume beyond recommended levels

RockBox Party Hire can demonstrate the recommended operating levels when the equipment is delivered or collected.

The hirer is responsible for ensuring that guests do not misuse the equipment.

10. Safety & Use of Equipment

The hirer must use the equipment safely and only for its intended purpose.

Equipment must not be:

  • Used outdoors in unsuitable weather
  • Exposed to rain or excessive moisture
  • Placed where it may be knocked over
  • Covered or obstructed in a way that may cause overheating
  • Used in a manner that creates an unreasonable risk to people or property

The hirer must ensure that children and guests do not interfere with electrical equipment, cables, speakers, lighting equipment or other hired equipment.

Where appropriate, equipment should be positioned so that cables and other potential trip hazards are safely managed.

11. Risk & Damage to Property or Persons

The hirer is responsible for taking reasonable care when using the equipment and for ensuring that it is used in a safe environment.

The hirer must take reasonable steps to prevent injury to guests, members of the public and other persons at the venue.

RockBox Party Hire will not be responsible for loss or damage to the extent that it is caused by the hirer’s misuse, negligence, failure to follow instructions, or failure to provide a reasonably safe environment.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under New Zealand law.

12. Cancellation

If you need to cancel your booking, please notify RockBox Party Hire as soon as possible.

A cancellation is not considered confirmed until RockBox Party Hire has provided written confirmation of the cancellation.

Customers should retain the written cancellation confirmation for their records.

Standard Cancellation Charges – January to October

Cancellation charges are:

72–96 hours before the start of the hire period:
25% of the hire charge.

48–72 hours before the start of the hire period:
50% of the hire charge.

24–48 hours before the start of the hire period:
75% of the hire charge.

Less than 24 hours before the start of the hire period:
100% of the hire charge.

13. November & December Bookings

Due to extremely high demand during November and December, bookings made for these months are subject to a 100% cancellation charge.

This reflects the increased likelihood that RockBox Party Hire will be unable to rebook the equipment and the delivery and collection schedules that are committed to other customers during this period.

Customers who are uncertain about their event date or whether their event will proceed should consider waiting until they are confident before making a booking.

14. Payment

Payment may be made by:

  • Cash
  • Bank deposit
  • Any other payment method agreed to by RockBox Party Hire

Unless otherwise agreed in writing, payment is required when the equipment is delivered or collected by the hirer.

Alternative payment arrangements must be agreed with RockBox Party Hire before delivery or collection.

The hirer is responsible for any reasonable costs incurred by RockBox Party Hire in recovering unpaid amounts.

Where permitted by law, interest may be charged on overdue amounts at a rate of 1.5% per month.

15. Hirer’s Responsibilities

The hirer agrees to:

  • Provide accurate booking and contact information
  • Ensure suitable access for delivery and collection
  • Take reasonable care of all equipment
  • Operate equipment according to instructions
  • Prevent guests from deliberately or negligently damaging equipment
  • Return all equipment at the agreed time
  • Return equipment in a clean and reasonable condition
  • Notify RockBox Party Hire immediately if equipment is damaged, lost or stolen
  • Notify RockBox Party Hire immediately if equipment develops a fault

16. Equipment Faults

RockBox Party Hire makes reasonable efforts to ensure that all equipment is tested and working before each hire.

If equipment develops a fault during a hire, the hirer must contact RockBox Party Hire as soon as possible.

The hirer must not attempt to repair or modify the equipment unless specifically authorised by RockBox Party Hire.

Where reasonably possible, RockBox Party Hire will attempt to resolve equipment problems or provide a suitable alternative.

17. Personal Information

RockBox Party Hire may collect and use personal information provided by the hirer for purposes relating to bookings, payments, equipment hire, customer service, administration and communicating with the hirer.

Personal information will be handled in accordance with applicable New Zealand privacy legislation.

Customers may have rights to access and correct personal information held by RockBox Party Hire, subject to applicable law.

18. Property Access

Where equipment remains at a location after the agreed hire period, RockBox Party Hire may contact the hirer to arrange its return or collection.

The hirer agrees to provide reasonable access to the equipment for the purpose of collection, inspection or recovery, subject to applicable law.

RockBox Party Hire will not enter private premises without appropriate permission or legal authority.

19. Compliance With New Zealand Law

These Terms & Conditions are governed by the laws of New Zealand.

Nothing in these Terms & Conditions is intended to exclude, restrict or override any rights or protections that cannot legally be excluded or restricted under New Zealand law.

Where applicable, the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, and other relevant New Zealand legislation will apply.

20. Acceptance of Terms & Conditions

By making a booking with RockBox Party Hire, accepting delivery, collecting equipment, or taking possession of the equipment, the hirer confirms that they have had the opportunity to read and understand these Terms & Conditions and agree to be bound by them.

If the hirer has any questions about these Terms & Conditions, they should contact RockBox Party Hire before accepting the equipment.

Any variation to these Terms & Conditions must be agreed in writing by RockBox Party Hire.
